The Cornell Seven: Parties; Punks & Privilege; Little Criminality

Women don’t get raped because they are drinking or took drugs. Women do not get raped because they weren’t careful enough. Women get raped because someone raped them.

19.3 % of American women “have been raped in their lifetimes” according to a 2014 reported released by the CDC. 1.6% of American women – two and a half million – “reported that they were raped in the 12 months preceding the survey.” At least 80% of those who are assaulted do not report the crime to authorities.

Social Media intelligentsia took to crucifying the “Cornell Seven.” I responded by recalling the “Central Park Five” who spent decades in prison for a sexual attack that they did not commit. I said, “wait for the facts.”

The “feminists” brutalized me. One inferred that all men were guilty. They were fine with that freak strangling her children but out for blood here.

I prosecuted some sex crimes in my youth. I looked at Cornell Seven court documents. I will be brutalized again.

The “Cornell Seven” is an impossible case to prosecute. Some will likely walk. As a matter of criminal law some probably deserve to walk. None of these boys were “nice.” They should all be beaten. But that’s not law.

In America you’re “not guilty” if there is “reasonable doubt.” And there is plenty of doubt about sexual assault here.

Most problematic are two questions: First what is “consent” or lack thereof when nothing is said. Especially when there is no physical force or compulsion accompanied by no physical resistance; or undetectable physical resistance. Second what is “intoxicated” without a BAC (Blood Alcohol Content) test. And when does intoxication make you helpless.

I’ve had some excellent bar fights while intoxicated. I wasn’t helpless or lacking in will.

Let’s see.

I read Jane Doe’s civil complaint. It is not well drafted. Her lawyers are not the best. But it’s the best her story will get. For legal purposes it’s taken as true all the way up to the conclusion of civil discovery.

Jane Doe arrived at the “fraternity house … intoxicated … about 10 standard drinks within 3 hours.” A young man named INGALLS, “greeted [her] and gave her a beer.”

They danced together in the main room of the fraternity house. “INGALLS pulled [her] off to a quieter area and propositioned her with having a threesome with her and another one of his fraternity brothers.”

This is key. Jane Doe’s civil complaint. The best it will get … says: “In her drunken state, [Doe] was incapable of consenting to this proposition. Despite being incapable of consent  INGALLS then led Plaintiff to the upstairs of the fraternity house and left her with Alex Vega.”

Nowhere does it say Jane Doe said “no.” Nowhere does it say she resisted. Nowhere did Ingalls use force. Jane Doe walked up the stairs herself. How was she “incapable of consent.”

That’s a problem.

It turns out that in a prior statement Jane said that she agreed – consented – to the threesome because she thought the two men were bisexual like her.

A bigger problem.

“INGALLS returned and led [her] to another room where NEWELL was sitting on a couch.”

“INGALLS and NEWELL [passed] around a plastic bag containing … Ketamine, a dissociative anesthetic.”

“INGALLS and NEWELL pressured Plaintiff into snorting the alleged Ketamine with them …”

What is “pressure?” “Peer pressure?” I was “pressured” by my parents to go to law school. No mention of coercion by force or threat. She was “plied with marijuana and ‘Jamaican Liquor.” “Plied” is a dramatic way of saying “supplied.”

“Soon after, INGALLS and NEWELL began engaging in sexual acts with Plaintiff, all without her consent.” Again no mention of force or the word “no;” or resistance. Then “INGALLS forced oral sex on [her] while Defendant NEWELL forced vaginal intercourse on her from behind.”

If you are using the word “force” you need to describe it. “Pulling.” “Pushing.” “Grabbing.” “Screaming.” Etcetera.

I thought I would not prosecute this case.

Then I read: “NEWELL slapped Plaintiff on the buttocks multiple times, resulting in bruising.” The bruises that were left – described later in the complaint – were brutal. “Detail” is key. That argues against “consent.”

INGALLS gets soft so he stops. “NEWELL [reaches] for her vagina with his hand multiple times … [she] pushed his hand away [a little late].” Finally a description of force and resistance.

LOPES enters the room, grabs her and kisses her “while NEWELL groped her from behind, specifically reaching for her vagina.”

LOPES and NEWELL “placed [her] on a bed and had sex with her without consent.” Where’s the detail? She placed herself into this sexual situation – was that not her consenting is the defense argument.

At 1:42 AM NEWELL sent a message into the XI CHAPTER’s member Snapchat group entitled “Chi Phi Actives,” “claiming there was ‘free pussy’ upstairs.”

This is an admission of depravity – not sexual assault.

“Multiple other members of XI CHAPTER entered the room and [Jane] retreated under the covers … to hide her naked body …”

A good defense attorney will ask multiple times, “why didn’t you try to leave.”

Now SARABIA starts kissing her without her consent. She “pushed him away.”

Finally.

Then her “phone was on the other side of the room and she felt as if there was no way for her to escape this room full of predatory, fraternity men.”

That’s weak. What does the phone have to do with escaping.

“NEWELL then poured a line of Ketamine onto his erect penis and commanded that Plaintiff snort it, which she did.” “Commanded?” How?

“NEWELL got in the bed with her and began groping her and reaching for her vagina.” While she was “lying on her back on the bed, INGALLS, NEWELL, LEE, LOPES, SARABIA, NORRIS, and KRETZSCHMAR” poured lines of Ketamine “all over her body” and snorted them.

NEWELL, LOPES, SARABIA, NORRIS, and KRETZSCHMAR leave.

Jane is “removed” by INGALLS and LEE to a “room, believed to be the Fraternity President’s Office.”

Did she walk? Was she carried or pulled?

INGALLS and LEE “made more lines of Ketamine and told [her] to snort one, which she did.”

She’s “completely incapacitated.”

INGALLS and LEE “force oral and vaginal sex upon her simultaneously.” She “lost consciousness.”

College gossip. She waited weeks to report it.

No rape kit. In order to make their case the prosecution has to primarily rely on a witness that took pains to describe herself as wasted.

Softie Ingalls and Lee might be convicted. Spanking Newell and Lopes too. Or all four can easily walk.

Sarabia, Norris, and Kretzschmar are probably going to walk. Especially from serious charges.

They all may get jobs with the Republican party.

Women. Girls. Do not place yourself in vulnerable circumstances with men. Even ones you know. They will commit depraved acts upon you.

This is America. https://raymondzuppa.com/maga-land/

Yes they should be punished. But you will forever remain raped.

If I were Jane Doe’s father I’d say,

“Jane go to class. Study. Hang out at the dorm or on campus with your girlfriends. Parents sacrifice a lot to send daughters to school. Learn.”

I know.

Then I would kill seven Cornell punks. I’m insane. “Not guilty” the jury would say.
